The Competitive Enterprise Institute (CEI), represented by Chris Horner, has filed three Notices of Intent to Sue NASA and its Goddard Institute for Space Studies (GISS). This legal action stems from NASA’s refusal to provide documents requested under the Freedom of Information Act (FOIA) for nearly three years. These documents are critical to the ongoing Climategate scandal, which has exposed potential document destruction and efforts to evade U.S. and UK information laws, as well as allegations of scientific fraud at the highest levels of climate research.

The requested documents relate to NASA’s correction of U.S. temperature records after errors were identified by Canadian researchers, internal communications on those corrections, and GISS employee Gavin A. Schmidt’s involvement with the RealClimate.org blog. The blog, linked to environmental advocacy, has been implicated in the Climategate emails for potentially censoring skeptical viewpoints. CEI has demanded that NASA release these documents within 30 days or face a lawsuit in U.S. District Court.
